Terms & Conditions
These Terms and Conditions govern the relationship between you, the passenger, and us, Magical Steps Travel (Hereinafter, “MAGICAL STEPS”).
By booking a trip, you agree to be bound by these Terms and Conditions.
These terms affect your rights to sue, governing law, forum, and jurisdiction; please be sure to read these terms carefully and make sure you understand your rights and obligations and our rights and obligations.
1. RESERVATIONS & PAYMENTS:
LOCAL DAY & HALF-DAY TOURS:
Tour Deposit:A deposit 25% per person is required to secure your reservation.Confirmation of the reservation will be sent by e-mail. Magical Steps cannot accept changes to reservations with less than 48 hours’ notice.The rest of the payment may be made either by credit card or in cash on arrival.When we receive your booking, we will check the tour availability, email you a booking document with the tour details, and ask for confirmation from you that you received it. Your booking will not be completed and your tour will not be organized until we receive your confirmation email. Magical Steps does not accept any responsibility for non-receipt. Magical Steps regret that we cannot accept booking requests less than 48 hours before the start of the tour.
EPHESUS TOUR FROM ISTANBUL:
Confirmation of the reservation will be sent by e-mail. Magical Steps cannot accept changes to reservations with less than 48 hours’ notice Half of the total payment must be paid in advance, the balance being paid on arrival.
LONGER TOURS:
Tour Deposit: A deposit of 50% per person is required to secure your reservation. The rest of the payment may be made by credit card or cash on arrival.
2. CHANGES TO THE ITINERARY FOR LONGER TOURS
For changes you make to your reservation from 30 to 10 days prior to departure, that affect arrival city, program extensions, room categories and/or passport name changes, an administration charge of up to $50 per-person may be applied. Changes to departure date or destination from 9-4 days prior to departure may incur cancellation fees.
We regret that we cannot accept changes to reservations within 4 days of departure. All changes are subject to availability and cannot be guaranteed.
3. CANCELLATIONS & REFUNDS
If you must cancel your trip, you must do so in writing. Cancellation refunds will be calculated as of the date we receive your written cancellation. All payments for travel services not provided to the passenger shall be refunded in accordance with these Terms and Conditions and in accordance with MAGICAL STEPS’ cancellation policy.
Administration Fee: There is a non-refundable fee of 10% of total amount of the tour package per person. This low fee reflects only our costs of administering a reservation, and is not intended to be punitive in any way. We realize the majority of those who cancel their reservations do so out of necessity. Refunds will be processed 10 days after our receipt of your written cancellation and travel documents. Please note that if you cancel 7 days or less prior to the scheduled date of departure, you will not receive any refund.
3.1. CANCELLATION CHARGES FOR LOCAL DAY & HALF-DAY TOURS:
If a customer cancels the tour more than three days prior to arrival, the full payment is refundable. In the case of cancellations made less than three days prior to arrival, 25% of the total amount is refundable. In the case of last minute cancellations (within the final 24 hours) customers must pay the full tour amount. If customers have chosen to pay cash on arrival, Magical Steps Travel will email a credit payment link of the penalty fee and our customer accepts and commits to pay the penalty fee to Magical Steps.
If the cruise ship does not dock in the agreed port and changes its route, the full tour fee will be refunded.
3.2. CANCELLATION CHARGES FOR EPHESUS TOURS FROM ISTANBUL:
If customers cancel the tour more than three days prior to arrival, after booking an Ephesus Tour from Istanbul and after the flight tickets have been despatched, the cost of the flight ticket is not refundable, but the balance of the tour fee is refundable. In the case of cancellations made three days prior to arrival, the cost of flights and 10% administration fee are not refundable. In the case of cancellations made one day before the tour date flight, the cost of flights and 30% of the tour price are not refundable. No refund will be made for cancellations made within the final 24 hours. Our customers accept and commit to pay the penalty fee to Magical Steps.
3.3. CANCELLATION CHARGES FOR LONGER TOURS:
Unless otherwise stated in the contract, for all cancellations we will refund the cost of your trip less the following per-person charges: Charges shown include a 10% administration fee.
Prior to departure Charge
60 days or more: 10% of selling price (administration fee)
59-46 days: 30% of selling price
45-8 days: 50% of selling price
7-0 days: 100% of selling price
4. RESPONSIBILITY OF MAGICAL STEPS:
The responsibility of MAGICAL STEPS and its affiliated companies is strictly limited. As a tour operator, MAGICAL STEPS organizes, promotes, and sells tour programs consisting of certain travel services, including surface, air, and water transportation, sightseeing excursions, and cruise/hotel accommodation that MAGICAL STEPS purchases or reserves from various suppliers (collectively, “Suppliers”). MAGICAL STEPS does not own or operate any of these Suppliers. The Suppliers providing travel services for MAGICAL STEPS’ tour programs are independent contractors, and are not agents or employees of MAGICAL STEPS. As such, MAGICAL STEPS is not responsible for any negligent or wilful act or failure to act of any supplier or of any third party. Some tours include visits to shops and merchants. MAGICAL STEPS is not responsible for any purchases you make during your trip, whether that merchant is part of the scheduled itinerary or not. By utilizing the travel services of the Suppliers, you agree that you will look to such Suppliers for any accident, injury, property damage, or personal loss to you or to those travelling with you, and that neither MAGICAL STEPS nor any representative of MAGICAL STEPS shall be liable.
MAGICAL STEPS is not responsible for any changes made to the itinerary or for any negligent or wilful act or failure to act of any supplier or of any third party.
Without limitation, MAGICAL STEPS is not responsible for any injury, loss, or damage to person or property, death, delay, or inconvenience in connection with the provision of, or failure to provide, any goods or services occasioned by or resulting from - but not limited to - acts of God or force majeure, acts of war or civil unrest, insurrection or revolt, strikes or other labor activities, criminal or terrorist activities of any kind, overbooking or downgrading of accommodations, mechanical or other failure of airplanes or other means of transportation or for the failure of any transportation mechanism to arrive or depart on time, sanitation problems, lack of medical care, or for any other cause beyond the direct control of MAGICAL STEPS.
MAGICAL STEPS reserves the right to correct promotional or pricing errors at any time, or to increase the program price in the event of cost increases due to changes in cruise fares, currency fluctuations, parking fee increases, taxes, or fuel surcharges. MAGICAL STEPS reserves the right to decline to accept or retain any person as a member of any tour or to cancel or alter the tour without notice, in which event your sole remedy shall be a prorated refund for any unused portion of the trip. Hotels and other accommodations are subject to change.
In the event that unforeseeable circumstances beyond the control of Magical Steps and/or its contractors prevent visits to any of the sites scheduled in the itinerary, Magical Steps’ liability is limited to the refund of entrance and parking fees at the sites omitted. Such circumstances might include natural or man-made disasters, inclement weather, labour disputes, traffic jams and unusually long queues. This list is not exhaustive.
5. MISCELLANEOUS CONDITIONS :
Magical Steps reserve the right to change the itinerary without notice if necessary because of unforeseen circumstances, such as closure of sites, labour disputes or adverse weather conditions but will always endeavour to substitute other attractions of equal interest and value.
Its the customers responsibility to be at the pickup point at the agreed time. Magical Steps accepts no responsibility for any losses incurred by the customers should they fail to do so.
6. MEDICAL ISSUES:
All customers must have their own travel insurance
You must advise us in writing, at or prior to booking, of any physical, emotional or mental condition which may require professional attention during the trip or may require the use of special equipment. If you fail to disclose any such conditions, MAGICAL STEPS may refuse to allow you to take the trip and you will forfeit the trip cost; and in such event we shall have no liability, financial or otherwise.
We cannot accommodate women past their sixth month of pregnancy. If you require a wheelchair, you must provide your own small, collapsible wheelchair. Certain features, and certain trips, are not wheelchair-accessible. We cannot guarantee any wheelchair assistance or accessibility in international destinations. MAGICAL STEPS reserves the right to decline any trip participant whose condition, in our opinion, may affect the health, safety or enjoyment of other participants.
MAGICAL STEPS is not responsible for the costs of any medical treatment you may require during the trip. Under no circumstances is MAGICAL STEPS responsible for the quality of medical care, or lack thereof, you may receive while on the trip.
